Procedure for 6530 Insurance
Insurance: Workers’ Compensation Leave
Time loss compensation is paid in accordance with Title 51 Industrial Insurance Act and the rules and regulations of the Department of Labor & Industries. To avoid overpayment of wages, the employee or the employee’s representative if the employee is physically incapacitated will complete a Leave Claim for Time Loss due to Injury Form and submit it to the payroll department within five (5) days of incurring an industrial accident. Upon approval, the request will be processed by the payroll department. Employees have the following options regarding pay while temporarily disabled due to an industrial accident:
- Industrial Insurance Payments Only – The employee requests a leave of absence and receives temporary total disability payments only (TTD) from the Puget Sound Workers Compensation Trust (PSWCT). The employee will no longer receive a paycheck from Stanwood-Camano School District. Pursuant to statute, industrial insurance payments begin after the employee has missed three (3) days beyond the day of injury. If the employee is still unable to work on the fourteenth (14) day, time-loss payments may be retroactively payable for the first three days following the date of injury or illness provided that treatment was sought on or before the fourth day following the date of injury or illness.
- Combination of Industrial Insurance and Stanwood-Camano School District sick or annual leave – If the employee elects to receive full payment using both industrial insurance and sick leave and/or annual leave, the process will work as follows:
- The employee may elect to supplement their entitled temporary total disability payments from accrued sick or annual leave balances. The combined total or temporary total disability benefits and leave benefits will not exceed the normal wages that the employee would have earned for the same period; OR
- The employee may elect to receive a full day (based on the employees standard work hours) of accrued sick or annual leave in addition to temporary total disability benefits, recognizing that this will result in a quicker depletion of available sick and/or annual leave balances.
No adjustment to the employees leave balance will be made if the employee chooses Industrial Insurance payments only. However, the Stanwood-Camano School District healthcare benefit contribution will cease which may affect the amount of the employee’s industrial insurance benefits.
